My understanding is the driver is subject to the same legal limits as an auto-driver. Plus if the boat's under motor, hence - driving, the driver can't have an open container.
Passengers can be plastered, as long as they don't try to steer. Not sure if them having open containers when the boat's in motion is ok. It's not allowed in a car, so ???
I figure, if you anchor up, pitch some jigs for a while, have a sandwich and a brew but your not getting plowed, whats the harm. But seriously - balance in a boat, and excess alcohol - good reason to keep a lifejacket on!

I asked last year or the year before while getting my safety inspection sticker. same rules for the boat driver as if they were in a car. everyone on the boat is welcome (of age of course). he really didn't care much about if the boat was moving or not, open container or not, but it just can't be in reach of the driver.

Just stay under the legal limit and don't have an open container when you're under power. If you're anchored or drifting, you can enjoy a brew.
