Full Version: Strawberry citations: Here is the law they reference to.

Here's the law that this "citation" is referencing that I got at Strawberry. I'm not paying a dime.
They lady that I talked to didn't even know the law they are referencing to, and didn't have any explanation.

TITLE 36 - PARKS, FORESTS, AND PUBLIC PROPERTY

CHAPTER II - FOREST SERVICE, DEPARTMENT OF AGRICULTURE

PART 261 - PROHIBITIONS

subpart a - GENERAL PROHIBITIONS

261.15 - Use of vehicles off roads.

It is prohibited to operate any vehicle off National Forest System, State or County roads: (a) Without a valid license as required by State law.

(b) Without an operable braking system.

© From one-half hour after sunset to one-half hour before sunrise unless equipped with working head and tail lights.

(d) In violation of any applicable noise emission standard established by any Federal or State agency.

(e) While under the influence of alcohol or other drug; (f) Creating excessive or unusual smoke; (g) Carelessly, recklessly, or without regard for the safety of any person, or in a manner that endangers, or is likely to endanger, any person or property.

(h) In a manner which damages or unreasonably disturbs the land, wildlife, or vegetative resources.

(i) In violation of State law established for vehicles used off roads.

Maybe I am Confused but not sure how that law applies to the fees for parking in their parking area. While I agree that the fees may or may not be valid in off season I dont understand the correlation with the above law . What were you sited for??? Maybe that would clear things up a bit. Were you parked in the dirt?

I was in the parking lot along with everyone else with their little tickets on their window.

261.15 is the law they reffered to on my ticket. When I called and talked to them she couldn't believe that the law I was stating to her was what I was cited for.

What group/organization issued the ticket?

I was at Renegade and it was issued by American Land and Leasure.

I asked her if they were a certified officer to issue citations and she said "No, we a a private organization that maintains campgrounds and facilities"

My question that I should of asked is can you turn it over to the Park Service or Game Warden and then have me cited?

Also, she told me that she would void all the citations issued that day... Why would they do that if any of this is legal?

Who did you call and talk to? Did the court have a record of the citations as having been issued?

I don't know specifically what you received but I would guess it was a warning since they can't cite you. And the warning is more like a threat that they can't back up since they don't have the right to cite you. I had something put on my vehicle once even though I paid for parking, but I did it at a different spot at Strawberry since I was moving around. I was annoyed they did that, so the next time I went I didn't pay at all and got another "warning". I would also bet that they can't pass it on to anyone else to cite you either. I myself would not worry about it.

I believe for a citation to be enforceable that it must be given by a certified "peace officer" whether it be a warden, sheriff or law enforcement.

I justed googled American Land and Leasure. They take care of campgrounds. Private company. There is no way this was sent to court. This citation has was not given by any police officer, game warden, or even wild life resource guy. Everyone is getting them though!

I have heard of many guys collecting these "citations", and not worrying about them. Just like me[:p]

Sure paying a fee sucks but I am grateful for the boat ramp, paved parking lot, running water, restrooms and docks. It would suck worse not to have these amenities!
Pay the fee and enjoy.

Paying a fee does suck! I usually fish at Chicken Creek: no paved road (HORRIBLE road, actually), no running water, one outhouse that I've never used (though passing motorists make frequent stops), and no boat ramp. If I could see my fees going towards ANYTHING other than a run-down outhouse that is used primarily by passing motorists, I wouldn't bitch about paying a fee. The fishery itself should be supported by my license fee, which I am happy to pay.

I think I'm going to try and "see what happens" when I don't pay the fee. Enough is enough.

I would almost be that most of the fee that we are paying right now is going to that Private Company! Not to the Fish and Game, or DWR.

I knew someone would chime in and say just pay the fee's... What happened to asking questions about things that don't match up? Why is it when one person complains about the citations to them they say "We'll just erase all the citations on that date" What?

This post is not about NOT paying. I will pay everytime when everyting is open. It's about Who the hell are these people? Where is the money going? And do they have a right to collect the money when the facilties are closed?

Call the company.. See what they say. Talk to them about the law THEY list. You'll get a lot of...umm I didn't know that!

The fee you paid for your fishing license paid for that boat ramp and paved road and running water....

This is a private company hired to manage campgrounds.Why are they policing the boat ramp?

The real question is are they really contracted to do so?

NOT! Your license fees do not pay for anything at Strawberry except fish, fish stocking, studies, and a little bit of enforcement. The DWR doesn't build roads, boat ramps, or rest rooms, let alone maintain them.

And, yes, the private company has a contract to maintain the campgrounds and facilities. The next time the contract is up for bid, I wish some of you who don't wanna pay would win the bid and let everybody park, launch, and camp for free.

Your license fees don't pay for Utah State Parks either. They pay for UDWR expenses.
