Any one that read the Idaho Falls post Register today. There was an Ice fisherman that had legally walked down the ice from a City Boat Ramp into a little bay that has houses around it to fish. He was harassed by a home owner that he was trespassing. The ice fisherman informed him he had been below the high water line and wasn’t trespassing. The home owner kept up the harassment and the ice fisherman waited around for law authorities to talk to him and when after a while they hadn’t shown up he left.

Well the land owner filed a trespassing charge on the guy fishing. The Fish and Game asked the County Prosecutor to file harassment charges on the owner. Bottom line he wouldn’t press the charges.

This same home owner did the same thing a few years back. The State AG ruled against him on the charges, they stated as long as the water was navigable and the person stayed below the high water mark he wasn’t trespassing.

It just so happens the home owner is the head of the local Republican chairman for the county and the County prosecutor doesn’t want to hurt his career by charging him. The Co prosecutor belongs to the same party.

The Fish and Game is going to continue to press forward on the issue.
This is pure b@@@@@@t by the prosecutor to not press harassment against the home owner.

I guess politics win over the law and the poor sportsman who was following the law.

I think the guys should go back with a tent and a weeks worth of food and just hang out and fish! Maybe the guy will have a heart attack yelling at him.

My fishing partner is a police officer over there and has even fished this cove that you are talking about! He said they have even put signs at the dock, preventing boats from going up stream! Also mentioned, if the guy doesn't harass you, he just gets your license number and files CIVAL trespassing charges against you! He is a lawyer himself and will basically just spend all of YOUR money in a court room!!!

It's really Sad how these elected officials don't uphold the law they get elected to enforce because of the money involved in politics. Seems once they get elected they forget what they were elected for.
I hope F&G can get this land owner, even though he's a lawyer, teach him he can't bully people on public waterways and they don't get bought out too. Ron

This very thing happened about 7 or 8 years ago during ice fishing season. Went all the way to the state court which ruled that since the water in the said area is diverted from the river and therefore can not be said to be separate from the river itself it follows under the Idaho states right of way laws. Since that time I've fished it multiple times in the summers, a few in the winter and I have had some ok fishing and some stellar fishing there (any that know about the background of this story should recognize my posts fishing there). As for a BFT luncheon it would be difficult to do unless someone has a pontoon boat that a grill could be set up on to make lunch. If there is such a person I'd be happy to help organize the party! But without some kind of watercraft you'll be hard pressed to make lunch or fish the area. I'm still curious which homeowner it is though since I've met several of them over the years and they've all been pretty friendly with the exception of a few teens joyriding their small jazz boat near me while I'm fishing.

Watercraft pontoon or ice I would be in for something I hate people who think cause there land runs right up to the high water mark they own the water also. We use to fish down to hagerman behind the hatchery where the waterfall is and lots of houses on the west bank. they went and posted the channel no trespassing and put posts across it. Did a bunch of checking and like stated above its high water and connected to the snake. we continued to fish it both wading from the hatchey side and by boat. even had one of the home owners spray us with a garden hose. we thanked them cause it was so hot and they left lol

I was involved in the original case. That water is legal to fish as long as you stay off their property at the high water mark. It was deemed navigable water that uses flow through from the Snake as was pointed out in an earlier post. There is nothing he can do about it and the Sheriff's dept. has pointed that out to him several times.

similar situation happened to us in CO we were hunting WMA land for jacks and coyotes when a group of 4 guys walked up on us, mind you we were MILES from any road, and told us how we were trespassing, and how hunting is a sin, bla bla bla.He informed me that he contacted the county sheriff, i said good, and we eventually walked out being harassed the whole time cause we were hunting. The sheriff met us at my truck, and brought a land owner who I had permission to hunt from. Both sides explained our stories, the 4 guys were each ticketed and given a summons to appear in court for sportsman harassment. they take that stuff very seriously out there, and I hope they do in Idaho as well.
