Depends on how many there were spearing. Proc states that the walleye limit is 10 with only over 24". If the spear fisher took more than 1 over 24" then they poached. If there was one 24" or over fish for each spearfisher then it was legal for them to take the fish.
The OP is a bit confusing with at one point a single person being mentioned and then the word "they" appears. We don't really know how many fishers or fish over 24" there were.
