That person who just walk by in your photo should not have the right to tell you to destroy your photo no more than you have. This law says differently.

This might be a little different than your example but here is what happened to me last year.
I was taking my daily walk when this guy pulls up in a car along the street I was walking, he gets out and starts video taping me, at first I though he was filming the building behind me but as I walked past, he turns his camera and keeps taping me as I walk past and down the road. I thought it was strange but kept walking, the next day, he is there again, I ask him nicely to stop taping me and made the comment that it was against the law. He starts screaming at me that no, it isn't against the law and he will do what ever he pleases. I didn't see him at that location again be a little while later, I saw him from across the street taping me again. At this point, I contacted the police and ask them if this was legal and they said, yes it was. I still did not like it, so I started carring a camera and the next time I saw him I went right up to him and started taking pics of him and his car. He did not like that, so I told him, "How does it feel". I decided after that, that I would change my walking route but it sure is a shame when people can tape you without your OK. I do believe that when someone ask you not to not include them in a pic or video that you should honor their wishes.
