I think you two are trying to argue the same side and don't realize it. troll is right in that a non marked fence does not always indicate private property. BUT a bared wire fence with every few posts painted orange, or signs that say "no trespassing" clearly indicate that it is private property.

you are right though, in that if there is a fence and someone comes and says that it is private ground, and you don't leave then you can be ticketed for trespass. That would apply whether it was marked on the posts or not.
