And if they drag around a float marker on top of the water I am betting that a ranger would consider it cert-worthy. They don't mess around these days.
However. If the diver simply enters the water without a boat or marker float...would he still be considered capable of being a mussel magnet? And if that is the case, when do wading anglers start coming under that ruling? They already come under scrutiny for transporting other organisms on the soles of their wading boots.
A worthy question for a patient DWR CO.
