This might be fine if anyone thinks the over 40" would surely not survive if the pond goes dry but the under 40 inchers will.
If everyone expects the reservoir to experience a major fish kill from low water what would be wrong with eliminating the limit for all species. This would cost nothing and would include the public in a solution to eliminate wasting, which is a crime no matter who does it.
