Changing Times
#1
I monitor another board and they posted the following:

[black]Close Call:[/black]

thought this would not happen to me, but it did! I was fishing today on my own. The same place I normally go to, and try to land a steelhead. I need to walk in about 1/4 mile.
I looked behind me and therewere four adult men, and no fishing rods. All I saw were brown paper bags, which they were drinking out of. As walk up river quickly,so did they.
I am trying to figure out where I need to go without a possible confrontation. The quicker I walk, they do the same.
Luckliy a drift boat with two guys come around the corner. The fisherman ask how I am doing, and I reply better now. These guys check out the boat, and stop moving toward me.
It gives me time to get out of there, and to my truck.I drive river a mile to another hole. The same drift boat comes along to pull out. I thanked them for showing up, when they did. I explained what happened, and they were very concerned. They wondered why these guys were there without fishing rods.
They told me that they are always carrying a weapon while fishing. Just in case something happens to them, like it did to me.
I do not know if if I will carry a weapon. But I will be more careful where I fish now! It is Sad to know that is possible for that to happen, while enjoying yourself on the river.
I wrote this for two reasons: I want fisherman to be safe, and I was really shook up!
Do I think something was going to happen, maybe not, but I think so!

In Oregon the it is Legal to carry a gun to and/from fishing.

166.260 Persons not affected by ORS 166.250.
(b) Licensed hunters or fishermen while engaged in hunting or fishing, or while going to or returning from a hunting or fishing expedition.

What is Utah legal standpoint on this?

I am pretty much in the same boat - I suppose I could get my Leatherman out and protect my wife and kids - or should I go get my CC permit?

Be careful out there!!!

You are so right about being careful now a days, even in the wilderness.Sad to say but we outdoors are just as easily prayed upon by [#ff0000](bleep)[/#ff0000] who get a few drinks in them and cant handle there liquor.I have heard of people Camping in the Uintah's and getting there things stolen during the night.Or even out to willardbay when night fishing having there vehicles broke into. You know why cant they just keep to themselves and let the outdoors be a man's safe place. We are there to clear our heads and enjoy the peace and some what quite time of fishing. No need to be enimies with anyone if you just enjoy whats around you and not take from others who are just trying to have peace. To tell you the truth in today's society,it will only get worse before it get's better. So for all of you who are making the outdoor's miserable for everyone else, beware, your day will come. PEACE!!!!!

It is fairly easy to get a concealed carry permit in Utah. However, during classroom training the instructor warns you to NEVER (IF AT ALL POSSIBLE) SHOOT ANYONE. Your troubles just begin if you do.

However, carrying a pistol usually discourages most scum bags and they usually leave you alone if they see it. NEVER THREATEN ANYONE OR USE A FIREARM UNLESS YOU ARE IN A LIFE THREATENING SITUATION.

For me, I would'nt leave home without it !!!!

I could very easily be wrong here, but I think in Utah, it's completely legal to carry a gun in plain sight.

I think the catch is that if you have a concealed carry permit, you're required to conceal it.

Sorry to hear that someone ruined your day so easily but unfortunately it happens some times. As others have stated you have two options to carry a gun in Utah. Have a concealed weapons permit which takes a little time and some money. The second option is cheaper and easier but can sometimes scare the wrong people (moms, kids, other fisherman). Carry your weapon in the open. If it is plain sight it is legal. I don't carry a weapon fishing usually but have carried a sidearm in the open during other trips in the mountains to help avoid situations like you described. Would never want to use it but had a person back off once when I quietly rested my arm on it as they approached. For what it's worth.

In Utah, you cannot have a loaded firearm in the car.

You cannot shoot within the city and within 600 feet of any houses or buildings.

You can legally shoot anybody breaking into your house or when your life is at stake.

In Utah, you can walk around with a gun in your holster in plain sight legally.

In Utah- we lead the USA in # of concealed weapon permits issued to private citizens.

James is correct, never fire at anybody or threaten anybody with it, your troubles starts right there no matter what the event pertains to. It can either be in the form of lawsuits and psychologically irrepairable (seeing someone blown away just simply doesn't go away, it stays with you).

We the citizens of Utah are a heavily armed state, and we are very proud of our right to bear arms per se the consitution.

I BELEIVE IN ALL STATES IT IS LEGAL TO CARRY A WEaPON (GUN KNIFE) IN PLAIN SIGHT. NOW BRANDISHING IT IS A DIFFERENT MATTER.
LASTS I KNEW WE DO HAVE THE RIGHT TO BARE ARMS IN AMERICA.
BUT IF THAT MEANS WEARING SHIRT WITH NO SLEEVES OR NOT. I HAVE NO CLUE (A JOKE).
I HAVE THOUGHT OF GETTING A CC PERMIT MANY OF TIMES.
I ALSO LIKE THE OLD SAYING THAT GOES SPEAK SOFTLY AND CARRY A BIG STICK, AND IF THEY DON'T HEAR YOU THEN YELL AND GRAB A GUN. THEN THEY MIGHT HEAR YOU. IT GOES SOMETHING LIKE THAT RIGHT?
I AM TRUELY SORRY TO HEAR THAT A FELLOW FISHERMAN HAD TO HAVE A INCOUNTER LIKE THIS. THAT SOME PEOPLE FEEL THEY CAN PREY ON SOMEONE FOR NO GOOD REASON EXCEPT TO MAKE THEM FEEL BIGGER.

I kind of doubt that it's legal to carry a gun, particularly a pistol, in certain "blue" states. California and Mass. come to mind as extremely anti gun. I haven't actually looked it up though.

[cool]I think you are right Mateo. In California if you have a CC then you can carry one in your car, but it has to be in a "locked box", and I think it may even have to be unloaded. Massachusets and a few other "blue states" are really strict. I don't remember the exact rules, but they went over them in my CC class that I attended. If I remember correctly, in Mass. you can't even have a handgun (like Canada, England, etc.-only the criminals can have them, but not the average law abiding citizen to protect himself and/or family). I do know that Nevada honors Utah CC's, or if you are carrying there and have a permit from Utah, your o.k.

It really is Sad that you have situations like the one described up above happening even in the outdoors where people are gonna try to mess with you for NO REASON. I have a Kimber .45 but it's really a little too big to properly or comfortably conceal, so I'm going to be getting a Makarov or 9mm sometime soon to start packing. Even right here in Utah, where some people still go to bed at night with their doors unlocked, there's a lot of sick people out there, and a hell of a lot of meth addicts who will do anything to afford their next fix, etc. It's only going to get worse (if you are religious, it's in the scriptures-if you aren't religious, it doesn't take a rocket scientist to see the times getting crazier as each year goes by. The stats don't lie.)

A lot of people have said that it is legal to openly carry a pistol in Utah. This is somewhat misleading, however. As read on Utah's BCI website:

"It is unlawful to carry a loaded firearm on any public street without a permit."

There are also very strict laws about how a handgun can be carried in a vehicle without a permit. The law may very may well be different out in the woods (other than when in a vehicle anyway), but I don't know for sure. In my opinion, if your going to carry a handgun you might as well get the permit. It takes a whopping 4 hours to go through the course and approximately $100 in classroom and application fees. It's good for five years and then is renewable for $10. That's a very small price to pay for the peace of mind that your not going to get arrested for a minor technicality of simply carrying it in the wrong place or manner. Below I have pasted the URL to Utah's BCI website. It has all the information you will need to get started on obtaining a permit as well as learning the law.
